Acceptable Use Policy (Platform-wide)

This Acceptable Use Policy ("AUP" or "Policy") sets out the conduct rules that apply to everyone who uses any service operated by APERTURESyndicate OÜ ("APERTURESyndicate", "AS", "we", "us", "our"). It is the umbrella policy for the entire platform and forms part of your agreement with us alongside the Terms of Service and the Privacy Policy.

Scope. This Policy applies to every Service listed in Section 2 of the Terms of Service and to all content, accounts, and activity on them — including ASAI (chat, roleplay, code and image generation), ETHERANE and the datasets marketplace, Resonance, ASMusic, ASVentor (including the media downloader), Support, SYNX, the developer portal and API, Lysicon Quanture, and the main site. It applies whether you access those Services through a browser, a desktop or mobile client, an API, or any other means.

Where this Policy sits. Our documents are layered, and the order is set out in Section 3 of the Terms of Service: the Terms come first, platform-wide policies like this one come second, and product-specific rules come third. A product document can only narrow, never widen. It may add detail or impose a stricter rule; it cannot permit something this Policy forbids, and it cannot lower a threshold this Policy sets — including the minimum age. Where a product document appears to do so, this Policy controls.

Some products have their own, more detailed rules because of what they do — for example the ASAI Acceptable Use Policy and the ASAI Roleplay Content Policy. Read them as additions to this one.

Minimum age. APERTURESyndicate is for people aged 16 or over. See Section 10.

We write these documents in good faith and keep them accurate to how the platform actually works. They have not yet been reviewed by qualified Estonian legal counsel.

1. Illegal content and activity

You may not use any APERTURESyndicate service to create, upload, store, share, transmit, link to, promote, or facilitate anything that is unlawful under Estonian law, the law of the European Union, or any other law that applies to you or to us.

This includes, without limitation:

Content or conduct that breaches Estonian or EU criminal law.
Selling, advertising, or arranging the supply of illegal goods or services, including controlled substances, weapons, stolen data, counterfeit goods, or forged documents.
Terrorist content, incitement to violence, or material that promotes or glorifies serious crime.
Using the platform to launder money, evade sanctions, or carry out any other financial crime.

Lawfulness is judged by the strictest applicable standard. Content that is legal in one place is not permitted on the platform if it is illegal where you are, where it is published, or under Estonia or EU law.

2. Child sexual abuse material and child endangerment — zero tolerance

We have zero tolerance for any content or behaviour that sexualises, endangers, or exploits a minor. This is the single most serious line on the platform, and it is absolute.

You may never use any service — including ASAI image generation, roleplay, chat uploads, datasets, or any other feature — to create, request, generate, upload, store, share, or seek child sexual abuse material ("CSAM"). This prohibition covers real imagery, AI-generated or "synthetic" imagery, drawn or animated depictions, text, and any sexualised depiction of a real or fictional minor. It also covers grooming, the solicitation of minors, attempts to arrange contact with a minor for a sexual purpose, and trafficking.

When we identify such content or conduct, we will, without warning and without exception:

Remove and preserve the material as required by law.
Terminate the account immediately and permanently.
Report to the competent authorities, which may include the Estonian Police and Border Guard Board, Europol, and recognised reporting bodies such as NCMEC, and cooperate fully with any investigation.

There is no route that restores access in these cases. Suspected child endangerment can also be raised directly with us at [email protected] — but if a child is in immediate danger, contact your local emergency services first.

3. Harassment, threats, hate, and doxxing

The platform is for building, creating, and collaborating — not for attacking people. You may not:

Harass, bully, or threaten anyone, or coordinate others to do so. This includes sustained unwanted contact, stalking, and targeted pile-ons.
Threaten violence against a person or group, or encourage, celebrate, or wish for harm to come to them.
Spread hate speech — content that attacks, dehumanises, or incites hatred or discrimination against people on the basis of a protected characteristic such as race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, or serious illness.
Dox anyone — publishing or threatening to publish private or identifying information (home address, phone number, workplace, identity documents, private communications) without consent, including to intimidate or enable harassment.
Promote self-harm or suicide, or pressure or encourage another person toward it.

4. Intellectual property and the ASVentor downloader

Respect other people's rights. You may not upload, generate, publish, or distribute content that infringes someone else's copyright, trademark, or other intellectual-property or proprietary rights. This applies to every service, including images you generate with ASAI, audio and artwork on Resonance and ASMusic, datasets you list on ETHERANE, and files you share in chat.

If you are a rightsholder, or your work has been used without permission, our takedown procedure is in the Copyright & Takedown Policy. Repeat infringers lose their accounts.

ASVentor and the media downloader. ASVentor's media tools, including the downloader, are provided for lawful use only — your own content, content you are licensed to download, or content where downloading is permitted by the source and by law. You may not use the downloader to capture, copy, or redistribute material in breach of copyright, of a platform's terms of service, or of technical protection measures. The specific rules and your responsibilities are set out in the Downloader Terms, and they apply in full.

5. Malware, phishing, spam, fraud, and scams

You may not use any service to harm others or deceive them. Prohibited conduct includes:

Malware and malicious code — uploading, generating, hosting, linking to, or distributing viruses, worms, trojans, ransomware, spyware, or any code designed to damage, disrupt, or gain unauthorised access to systems or data. This applies to ASAI code generation, chat and dataset uploads, API integrations, and everything else. We do not scan uploads for malware — see Section 11 — so this rule is enforced by consequence, not by a filter.
Phishing and credential theft — pages, messages, or campaigns that impersonate a person or service to trick people into revealing passwords, payment details, or other sensitive information.
Spam — unsolicited bulk messages, repetitive or automated promotional content, link-spamming, or any abuse of messaging, comments, or publishing features.
Fraud and scams — deceptive schemes of any kind, including investment and crypto scams, fake giveaways, advance-fee fraud, payment fraud, chargeback abuse, and misrepresenting who you are or what you are offering.

6. Security, abuse of the service, and responsible disclosure

The platform's availability and integrity are shared resources. You may not:

Probe, scan, or test the security of any APERTURESyndicate system without our prior written authorisation. Unauthorised penetration testing is not permitted.
Exploit a vulnerability, bug, or misconfiguration, access data or accounts that are not yours, or attempt to bypass authentication, authorisation, or any access control.
Disrupt or overload the service — including denial-of-service (DoS/DDoS) attacks, deliberately resource-intensive requests, or any activity that degrades the service for others.
Evade or circumvent rate limits, usage quotas, technical restrictions, content filters, or any suspension or ban — including by creating new accounts, rotating credentials or addresses, or using automated tooling to get around limits.
Interfere with, reverse-engineer, or tamper with the operation of the service except to the limited extent that mandatory law expressly permits.

Found a vulnerability? Report it — do not exploit it. Our Responsible Disclosure Policy explains how to tell us safely and what good-faith research we welcome. Acting within that policy is encouraged; acting outside it is a breach of this AUP.

7. Scraping, automated abuse, and reselling access or output

Automated access is allowed only through the interfaces we provide for it (such as the public API — see the Developer & API Terms) and within their published limits and terms. You may not:

Scrape, crawl, or harvest content, data, or personal information from the platform by automated means, except where we expressly permit it.
Use bots, scripts, or automation to generate artificial activity, inflate metrics, abuse free tiers, or otherwise place undue load on the service.
Resell, sublicense, redistribute, or commercially exploit access to the platform — or the output it produces, including AI-generated text, code, images, or audio — without our permission, except where the relevant product terms grant you those rights.

Legitimate use of our public API, within its terms and quotas, is exactly what the API is for; circumventing those terms is not.

8. Impersonation and account abuse

Your account represents you. You may not:

Impersonate any person, organisation, or APERTURESyndicate itself — including using someone else's name, likeness, logo, or identity to deceive or to imply an affiliation or endorsement that does not exist.
Create or use an account with false or misleading registration details, or operate accounts to evade enforcement.
Share, sell, rent, or transfer your account or credentials, or let others use your access in breach of your plan or the applicable product terms. You are responsible for everything done through your account.

9. Misuse of AI features

Our AI features — ASAI chat, roleplay, code and image generation, ETHERANE, and the AI tools inside ASVentor — must be used responsibly. On top of the product-specific rules, you may not use any AI feature to:

Create deepfakes or other synthetic media that depict a real, identifiable person without their consent, particularly where it is sexual, defamatory, deceptive, or designed to harm or humiliate.
Generate or spread disinformation — content engineered to deceive about facts, events, elections, health, or identity, including impersonation of real people or organisations and fabricated "evidence".
Produce content that violates any other section of this Policy, or attempt to jailbreak, manipulate, or bypass the model's safety measures.

AI output can be wrong, biased, or fabricated, and you are responsible for how you use it. See AI Output & Limitations for what AI-generated results are and are not, and your obligations when relying on or publishing them.

10. Minimum age and eligibility

APERTURESyndicate services are for people aged 16 and over. You may not use the platform if you are under 16, and you may not help anyone under 16 access it. This is a single platform-wide minimum and no product may set it lower.

We do not verify age. Registration asks for a date of birth and nothing checks it — no documents, no identity provider, no estimation. Where we learn that an account holder is under 16, we close the account and delete the data; we act on knowledge, not on suspicion. If you need a real barrier for a child, device-level controls are far more effective than anything we offer. Some content and features are restricted to users aged 18 and over, and we age-gate where the law or the nature of the content requires it.

11. How this Policy is enforced

We are reactive, not proactive. We do not generally monitor what you post, and we do not run automated content scanning across your posts, uploads, datasets or private messages looking for violations. There is no malware scanner on uploads, no keyword filter on messages, and no automated check on published content. We act when someone reports something, when a competent authority orders us to, or when we otherwise become aware of a problem.

What is automated is infrastructure protection: rate limiting, abuse and fraud signals, and detection of anomalous account activity. Those systems can throttle a request, block traffic, or lock an account temporarily. They look at behaviour and traffic, not at the meaning of your content.

Where a decision affects your account or a specific piece of your content, a person makes or reviews it.

When we determine that this Policy (or a product-specific policy) has been broken, we take action that is proportionate to the seriousness, intent, and recurrence of the conduct. Depending on the circumstances, that action may include any one or more of the following:

A warning explaining the problem and what must change.
Content removal or restriction — taking down, hiding, age-gating, or otherwise limiting the reach of the content in question.
Account suspension or termination — temporarily limiting features, or permanently closing the account and barring the user from the platform.
Referral to the authorities — reporting conduct to the competent authorities and cooperating with investigations, particularly for the categories in Sections 1 and 2.
Other measures reasonably necessary to protect the platform, our users, and third parties.

Serious violations — such as the child-safety matters in Section 2, credible threats of violence, or large-scale abuse — may result in immediate termination without prior warning.

Statement of reasons. When we remove or restrict your content, or restrict or terminate your account, we tell you what we did, why, whether we relied on the law or on our own rules, and whether automated means were involved. This is the statement of reasons required by Article 17 of the EU Digital Services Act.

If you disagree, write to [email protected] with "Appeal" in the subject line and a person will look at the decision again. We do not operate a formal internal complaint system or out-of-court dispute settlement — as a micro enterprise we are exempt from those obligations and we do not pretend to run them. What we do and do not offer is set out plainly in DSA Notice & Action, Sections 6 and 7. Your right to go to court is unaffected.

12. Reporting a violation

Because enforcement is reactive (Section 11), reports are how most problems reach us. If you see something on the platform that breaks this Policy, tell us.

Report it to [email protected] with "Illegal content" in the subject line and enough detail for us to find and assess it — ideally a link or location, which Service it is on, and a short description of the problem. We aim to confirm receipt within 72 hours. The full procedure is in DSA Notice & Action.

For copyright or trademark, use the Copyright & Takedown Policy; for security issues, use Responsible Disclosure. For anything that puts a child or any person in immediate danger, contact your local emergency services first.

We review reports and act on them under this Policy. We do not tolerate retaliation against people who report in good faith.

This Policy is governed by the law of Estonia, with the courts of Tallinn having jurisdiction, and is subject to the GDPR, the EU Digital Services Act, and applicable Estonia and EU law. The English-language version of this Policy is the controlling version.

Version history
